CANADIAN CONTEXT
Artificial intelligence in medicine in Canada
In Canada, clinical information governance combines federal standards with provincial and territorial laws and policies. There is no single national rule that resolves all health data uses; location and the type of organization matter.

Medical record and artificial intelligence in Canada
Jurisdictional responsibility
Obligations vary by province or territory, type of custodian, and activity. An assessment must first identify which regime applies to the custodian and the provider. Health Canada: Privacy ↗
Shared health data
The Pan-Canadian Health Data Charter proposes common principles for the use, access, sharing, and protection of data, without replacing applicable laws. Pan-Canadian Health Data Charter ↗

Clinical documentation challenges in Canada
- Working with different provincial laws and residency or data transfer requirements.
- Integrate tools with clinical systems and standards that vary by jurisdiction.
- Maintain bilingualism, accessibility, consent, and professional supervision where appropriate.
These challenges are not solved with more text. They require useful information, defined owners, and a review process that corresponds to actual practice.

The evaluation changes from one province to another
A Canadian clinic cannot evaluate a clinical assistant using solely a federal list. Ontario regulates health information custodians through PHIPA; Alberta uses the Health Information Act; and British Columbia combines distinct rules for public bodies and private organizations. The first step is to identify where care is provided, which entity custodies the record, and whether the provider processes information inside or outside Canada.
This difference affects contracts, incident notification, patient access, and data transfers. The Office of the Privacy Commissioner of Canada maintains a guide to provincial laws and authorities; Alberta also publishes its Health Information Act. An organization must contrast those rules with its own policies before initiating a pilot.
It is also advisable to separate direct care, research, analytics, and model training: an authorization or contract valid for one purpose does not automatically extend to the others. The medical record and clinical activity must be evaluated in the province where the provider operates.
What to evaluate before adopting clinical AI
A Canadian provider must check the applicable provincial or territorial law, the role of each custodian and provider, data location and transfer, contractual agreements, and the clinical validation process.
